Associate member in co-op. housing society

Dear Sir

Can assosiate member become the member of managing committee of a housing society as per amendment passed on 14/02/2013?

No he cannot become a member of the Committee - Section 24 read with Section 28 (7) of the amended act deals with the rights and privileges

of a nominal/associate member

Section 24 of the Maharashtra Co-operative Societies Act, 1960 says

"--------- an Associate Member, may, subject to the provisions of sub-section (8) of Section 27, have such privileges and rights and be subject to such liabilities of a member, as may be specified in the bye-laws of the Society."

Sub-section (8) of Section 27 pertains to nominal and sympathizer members only. Hence in my personal opinion if the bye-laws are amended to enable Associate Members become members of the Managing Committee.

I have also attached "Guidelines" issued by the Federation on the subject.

It appears to me that certain sections  the Maharashtra Act and the Model Bye-laws were drafted by Mohammad - bin - Tuglak.
