Appeal against interim order to pay one time 25 k.

Hi,

in my DV case , the magistrate has passed an interim order to pay her 25k one time , despite of the fact that she is highly qualified and earns almost double the salary of mine.

she has filed this case after 2 years of separation, withot considering any factors or evidences put on record the MM has passed this order , in Mumbai.

 

I want to appeal against it and want to appear in person for this, due to the holiday season , delay in getting the order copy and some other unavoidable circumstances i could not file his appeal in time.

 

what is the process to do this appeal, can anybody please guide me on this .

With in 30 days from the date of order or date of service of order whichever is later, you can file an appeal in the Sessions Court. If it is delayed explain the reasons for such delay and pray for condonation of delay and if courts finds those reasons genuine, it will admit the appeal for adjudication.
