Apartment parking problem

Hello

 

I bought an apartment in Bangalore in which there are only 8 units (Ground + 3 Floors. 2 units in each floor). 3rd floor in the apartment is not approved and Builder told us that 3rd floor units will not have covered parking. Builder did not bother to mark and allot parking slots. Few owners (6 of them who own units in G,1st and 2nd Floor) got together and marked parking areas and allotted parking slot.  The builder is least bothered and does not even visit the apartment.

Now, the owner of one of the units in 3rd floor claims he has paid for covered parking and has occupied a parking slot and is not willing to vacate it. We requested him to produce/show his sale deed and prove that he has paid for the parking for which he is not agreeing. We confirmed from other owner of 3rd floor unit that he was not given parking facility.

 

Now can you please by:

1. What is the best way of resolving the problem in hand?

2. What are my legal options? Can I lodge a police complaint?

1st of all your apartment needs to form an association which should be registered, so that the committee can be formed who could look into the day to day affairs of the apartment. if there is less parking facility, then the members needs to decide a solution to avoid the conflict. going to the police and lodging FIR is not a permanent solution.
