Any such rule for practicing lawyers / advocates

Hi Friends,

I need to clarify, that is there any rule or law that a lawyer / advocate practicing in any particular Court of any state in India;cannot file Vakalatnama in another Court or State of India for his / her client ?

For expample -  A lawyer practicing in Patiala House, New Delhi cannot file Vakalatnama in the District or Session Court of Solan, Himachal Pradesh for his / her client ?

Please advise and oblige !

Hello dear,

He must have license to practice in the desired court. If he has the license, he can file vakalatnama.

Yes  an advocate  can file  vakalatnama on behalf of his client anywhere in India, mentioning therein the  enrollment no with the State Bar council.

As per Advocates Act, an advocate enroled in any State Bar council is entitled to practise anywhere in India.  But, most of the times, the bar associations put  their own conditions of appearance of their own bar members.  To surmount this difficulty, the Advocate from Patiala House Court can add any member of Solan bar to accompany him in the court.
