Anticipatory bail

My wife and inlaws logded a false complaint against me in 406/498a. They are looking for out of court selltement and asking for around 15 lakhs. The actual money which they have spent on marriage was around 6-7 lakhs

 The negotiations are going in care of Police but i don't think any result will come out. Both parties have met around 4-5 times in a police station but there has been no result. Police approach is supportive towards us. There has been no FIR as of now but only a complaint on the basis of which settlement negotiations are going on

Should we apply for Anticipatory bail ?

Although anticipatory bail can be sought even before the registration of the FIR, it would be practically difficult to do so in view of the approach of the courts. Wait till the FIR is registered. Mere registration of FIR does not mean that the police would arrest you. You can apply for AB once the FIR has been registered.

I endorse what has been said above, in slight distinction to the same I would advise you to approach the court for anticipatory bail the court would in all probabilty direct the police to give you 7 working days in case they desire arresting you.

Do we get sufficient time to apply for Anticipatory bail when the FIR has been lodged
