I have a flat with Amrapali and took a loan from BOB. Now as the project is at halt, the bank is forcing us to pay the interest. There is a case running at court against Amrapali as we all are aware but now my bank BOB has registered a case of non payment against me.
I have been asked to summon. Please help what do I do now.
When a case was filed for recovery, you can only defend your actions. Consult a local advocate file a counter explaining the reasons beyond your control and the present legal issues with the developer, provide such documentary evidence with those documents. The counter should clearly state the personal loss to you and your inability to repay EMI for things beyond your control. Appreciate that BOB is a PSU and they are not giving their money, and they have an obligation to repay the amount to depositors, and it is their duty to follow a laid down procedure for recovery.
