I have been removed from service with clause "Shall not be a disqualification for future employment" after about 7 months of suspension w.ef 01.05.2019. Now to secure future employment opportunities i have applied for issuance of a Service Certificate or Experience Letter but the HR Department is telling that they will be able to provide me the same for up to september 2018 only as the period of suspension succeeding that cannot be considered as duty but was in service till april 2019 as i was a provided with sustenance allowance.
My query is that whether being on duty and being in service the same.
Sorry, the HR is correct in saying so as per FR ( fundamental rules). However, you could have appealed your removal from service either to the competent Authority or to the labour court. Now the question here is that who will appointment you in future with such experience or service certificate.
