Ownership Flat on Leasehold Land

Dear Sir

 

Facts:

  • An ownership building built on leasehold land(lease 99 years)
  • Remaining Lease 45 years
  • Court Case since past ten years filed by owner of land for recovery of Lease.

 

Query

1)       Is it advisable to purchase flat in the said building?

2)       Can the owner of Land refuse to renew the lease at the end of the term of 99 years and vacate the residents who own the flats?

Refusal of lease - Yes.

Recovery period lease period - No unless lease agreement contains such a clause.
