Murder, Attempt to murder, Hurt, or Grevious hurt.

It a person suffering from corona spits on another person. In doing so the other person gets infected

case 1 - What will be the charges against the spitter if the person on whom he has spit dies.

Case 2 - He doesn't die but still get infected from the spit.

Also take in consideration that if an HIV positive person have an intercourse with a non HIV person what will be the charges levied against him.

In addition he will also be charged under Sec. 188  of IPC for disobeying a Govt. Servant. He will also be charged for Sec. 319 &321 IPC, for causing hurt and grievous hurt.



To my knowledge, such a case has not occured and  is unlikely  to occur.


What are the facts of the case, offence contents of FIR, report of investigating officer, charges, prosecution and defence evidence(s) ?
