I have a case in which 9 persons are accused in a fraud. During the course of Trial one person placed application stating that
he has become lunatic and state is unsound mind. Court got the petitioner medically examined and reports of IHBAS also confirmed
him as unsound mind. Court ordered to stay proceeding against the unsound mind person but the son of petitioner on behalf of unsound mind accused is repeatedly filing writ to stay the entire proceedings of case citing CRPC 328,329 & 330 along with the Chapter 17 volume III of Delhi High Court.
Please advise me the court decisions or advise how to proceed counter. whether proceedings against other 8 accused may continue.
