138 NIA APPEAL r/w sec 391 crpc

Learned advocates,

In my friends case, he has been convicted by trial court for 1 yr and fine i.e cheque amount of rs. 100000 if not paid then additional imprisonment of 2 months

Now during trial he has not produced any documentary evidence in court as he was not able to find them....

Now he has filed an appeal against order of conviction.... Now my question is can he produce the evidence now before sessions court under sec 391 crpc??

If yes then is it necessary to take prior permission from the sessions court for the same or straight way he should produce evidence?
