I got married last year but having problems from 1st weak, now i had decided to marry second. As per muslim law I can do, but as per indian law will I face problems? I wan divorce from my present wife. pls suggest what should I do?

If your first marriage was done under Sharia law then you can marry second time even without divorcing your first wife.

Agree with the expert Devajyoti Barman.
If you are serving in Government / public sector your service rules may not allow second marriage without divorce.

Yes, second marriage is possible. However, it requires permission if you a Government servant.

Even if legally no offence in case of sharia marriage, but of you are employed on a Government post that would tanatamout to an indiscipline on your part attracting disciplinary action against you by your deparment, as bigamy is not allowed on Govt. jobs.

Ther is some more questions in my mind so pls help......
I don't need any permission from my wife n her familyfor second marriage ? In any circumstances she won't be able to lodge any complaints against me? I wan to divorce her but scared, if she or her dad will lodge any false complaint against me or my family complaint like 498 etc.....

Dear All,
I got married in June 2015, but from last 9 months we are living separate. Now they had taken a support form human rights (private Ngo). They demand me to leave my parents n live with her separately, which i won't be able to do. Before marrage I was done a job but, from last December onwards I m doing my own business they r too against with my business also. My Father in law is also involving in my personal life and make my life hell. My whole family is distributed, finally i had taken a decision to take divorce and they r ready to give but they want 20lakhs Rupees which they had expended on marrage. So pls guide me what can I do.

Don't accept their demand. Ask them to contest the divorce case and wait for the decision of the court. However, if she files 498A case, you will have to fight that on merits. You can't avoid that.
