Registered property on my mother's name by grandfather.

Querist : Anonymous (Querist) 08 October 2017 This query is : Resolved
Hi,
I have query. My grandfather made partitions of land and registered on 3 of his childrens.( 2 Daughters and 1 son ) Two them got around 70 cents and my mom got 80cents and home. Now they are asking share or negotiation for the home which is already grandpa registered on mother's name. If not they will file case against this property asking for a equal partition.

I am very doubtful about this issue. If they file the case will it effect us. Please give me a suitable advice.

The partition of the self acquired property done by the grandfather during his lifetime is full and final for all purposes and now if any one challenges it will not succeed. To prove that the property that the grandfather partitioned was ancestral and not his self owned shall be on the party which challenges the partition.
The time/year the partition was done has not been nor the actual status of the properties partitioned in the question and reply is based on assumption/presumption only.

Your mother has got the property through registered partition deed now your mother is absolute owner of the property, now other parties have no ground to challenge the partition.Even if they challenge they will not succeed.

No advice from me to an author who is anonymous.

You can post the query in fresh thread with your identity and material facts.

A court could be approached if there is a cause of action. There appears to be none.

Was it a partition deed or a settlement deed or gift deed?
