Trees and tenant dispute

Am narayanan and reside in my own house since 50 years in a village. Am interested in nature and growing trees my adjuscent house owner is my relative. Now the adjucent house is occupied by a tenant for rent since two years. Trees in my gardens are twenty year old. Now the tenant lodge a police complaint for remove the tree because of leaves fell down in his boundry and some branches of tree are in tenants boundry. Enquiry has been done by police with me and house owner. I refused to remove three and a single branch of my tree as the adjucent house owner extented suporrt for me to grow tree and no little bothered about the complaint. Also he give a written statement in police station that the tenant can vacate the house if he feel diacomfort about my house tree. Now It seems that the tenant may approch court. Please advice me come out of this issue and save my tree.

In such situation, if advised properly, the person need to go to court and waste time and money.

He can give application to the SMD.

Had his plea been justified then police was having powers to ask you to remove the nuisance on other land.

You may give application to the forest department that you want to cut green tree on your land simply because the tenant (not owner) of adjacent house is objecting. Most probably they will reject the request made on this silly ground.

Mr. Narayanan,

Even the owner of that house cannot compel you to cut the branches of the tree, what to say of his tenant. So, sleep peacefully in wait of the legal notice.

However, immediate solution lies in your relative's serving his tenant with a notice to vacate the house.

Thanks all. I was litle busy in work. That's why i couldnt reply. The tenant already issued a legal notice and filed a suit in court that tenant is threatned by owner for vacate the house. Also he is seeking time till he find another house.

Is there any way to deal this issue with national green tribunal or pollution control board or forest dept from my side to save the trees and vacate the tenant. Because the tenant always giving me a mental agony.

Whether the landlord has any objection to the trees or branches/leaves of the trees?

Tenant has no locus standie without impleading the landlord.

Consult and engage a local lawyer for proper guidance and proceeding.

The tenant has moved against landlord.


Probably there is NO mention about leaves falling from Tree and there is NO complaint against you.


If you are entangled, entrust the matter to your counsel and your counsel shall handle it for you.

Thanks for reply. Still the issue is going on .... Tenant is still incisting me to cut the tree thru police and Heath Dept. But they are ignoring ... Thanks for the response.....
