Women Physical, Metal and Financial Harassment

My husband is doing physical and metal harassment with me from last 11 years, he snatches my salary, my scooty and my jewelry. All time he asks money from my father. I need divorce otherwise he will force me to commit suicide. Please give suggestions what to do and recommend any good lady lawyer in Moradabad.

Before filing suit for divorce first lodge complaint with Police and initiate a case u/s 498A, 406,232, 506, 384 IPC.
This bloke must be brought to books.

If you have no maintenance demand and to avoid court, police, better try to file a divorce suit on mutual consent. Failing which you can file a divorce suit on contest.

But if you have demand of maintenance, rent, compensation etc.then better to file a case under Domestic Violence Act in Judicial Magistrate Court. You can file another case under 498a IPC.

As the matrimonial disputes are semi legal and semi human behaviour so I shall suggest otherwise than the set line of experts attending such queries.

First of all my simple question is whether you have decided to come out from the inhuman behaviour meted out to you by your husband? really......you have decided to fight against him?

My question is though not legal but this is mandatory to be raised on my part just because a sense of courage and determination is the prime need if you revolt against the atrocities which you re silently tolerating since a long period of 11 years.

Once you determine then move an application to police either directly or through woman cell against your husband against his harassment. Change password of your ATM Card and don't give it to your husband. Use your money as you wish. File DV Act petition and ensure the residential rights from that litigation.

Engage a competent and appropriate lawyer for litigation purpose.

There may be rebuttal from your husband against all such 'efforts' to save yourself but don't afraid and take constant help of police authorities.

Such persons are indeed not fit to be left to loose around in a civilized society.


Prefer to find a very able counsel specializing in such/family matters and discuss in advance....and act as advised by Expert Mr. Devajyoti Barman.



Once you are properly informed and satisfied you shall be able to secure irrefutable evidence as well.

It is seen that wives keep on tolerating till they reach to the stage of either committing suicide or to surrender for ever so better to avail the social legislation meant for their rights.

Launch Section 498 A and 406 proceedings against your husband.,He would be sent to jail for cruelty and criminal breach of trust, criminal intimidation etc.

These days the position is changing, some wives have forced their husband for suicide by initiating true / false cases against them.

Hon'ble Apex court has recently held not to arrest the accused in such cases except in the extra-ordinary circumstances so chances of alleged harassment of husband side shall definitely get reduced automatically in case of misuse of provisions otherwise meant for the protection of married woman.
