Request to provide judgements in regard to employees working in maintenance unielectrical and civil

(Querist) 24 April 2015 This query is : Resolved
Dear Sir,

I have read some where that the employees who are working for Maintenance of Electrical and Civil works are considered to be looking after perennial works and not temporary ones.

It is requested to kindly give me the reference of judgements in favour of employees who were working for the maintenance of civil and electrical complaints in the Govt. of India Department.

With regards,

C. Mohan

Sir,

Initially I was appointed in a Govt. of India's Project. Lateron the Govt. of India created a Maintenance Unit of Electrical and Civil under the same Project. I was also working under this Maintenance Unit.

After completion of the said Project, my services were terminated on the plea that the Project was wound up and the project was of temporary nature.

Sir, since the Maintenance Unit was created under the same Project and I was working in the same Maintenance Unit as key person, it can not be said that the Project was of temporary nature. I have read that if someone is working in Maintenance Unit of Govt. of India Offices, then the employee who are working in the same, are looking after perennial works and not temporary works.

It is humbly requested to kindly advise in the matter.

With reards

If you were a contract and temporary worker, you cannot claim the rights, moreover you were working in a project which was dismantled, and naturally the temporary arrangement or employment gets terminated upon the completion of project. What were the conditions or terms of employment? Consult a labour or service law practicing lawyer in the local and seek his advice on the intended remedy.
