Banking customer

My daughter's school has a fees arrangement with a bank where we use to deposit school fees. In this case shall we be treated as customer/consumer or not, please provide the reply.

Vague query. What for you need to be treated either customer or consumer?
However, for the bank you are a customer and for school you are a consumer.

Actually some days ago I had experienced some misbehavior from bank's side.
I was aggrieved and decided to complain to higher Authority.After that I may approach to Consumer Court. But I have no such A/c like SB,CA,FD .....ETCin that bank.So I am little bit comfused, about my status.School is the A/C holder.
Hope I have explained my position properly.

lodge complaint with bank OMBudsman . cases before consumer forum go on for 2 years .

1. You are not a consumer to the Bank as per Consumer Protection (Amendment) Act, 2002 but are a consumer to the school from where you are buying service against payment,

2. For the misbehaviour of the Bank, you can lodge a complaint before the Bank's Ombudsman. It will have desirable effect.

Yes, there is a emerging problem, a grey area. Many institutions now require their patrons to credit the fees etc. directly into their account. This is an informal arrangement.

It is high time that RBI takes note of this emerging situation and issue appropriate guidelines/instructions.

Unless and such norms have been brought into force, the real question is whether an institution can compel a private person to credit moneys due to them in their account? Who is answerable if there is some lapse?

Definition of customer of Bank differ as per experts. Some experts consider only account holders as customer while other consider the person who is using any service of Bank is customer.

You can Complain to chairman, region office and Manager of the Branch for alleged misbehaviour. Most of the Banks have effective and well in built mechanism to deal with such complaints. If it is public sector Bank, take RTI route to know the fate of your complaint.

Person making remittance of school fees, is not a customer of the said bank. You may complain to the School Principal, who can take up with bank and their higher authorities to discipline the staff who misbehaved. Any legal proceedings, for this matter is waste of money, energy and mental tension. If possible remit fees through another person. This may be an isolated instance.

The choice of one branch of one bank is a mutually agreed arrangement between bank/school.

Here the bank/branch/BM benefits as collection is high and footfall/walk in customers are increased.

If BM has failed to inculcate decorum in the staff then being functionary head he/she along with offender staff is responsible and can be taken to task.


Lodge a police complaint alongwith other parents as witness.........................and office bearers of Parents Assoc. if any.

Supply the information of police complaint to Chairman of the bank, and GM-HRD, and CITE THAT RBI HAS PUBLISHED GUIDELINES ENOUGH NUMBER OF TIMES THAT BAN/BANKER CAN NOT BE RUDE WITH ANYONE INSIDE THE BANK/OUTSIDE THE BANK.........................................AND RBI GUIDELINES HAVE STATUTORY FORCE...........................ARE MANDATORY..................AND ARE NOT DISCRETIONARY.


BANK, BANKER IS HUMBLE SERVANT TO ANYONE THAT WALKS INSIDE THE BANK TO DO BUSINESS WITH BANK.

Demand from Chairman of the school to shift the business to some other bank....................



Publish in media...................and tame and shame such bank and banker................to the greatest possible limits.





Issue a legal notice to BM, Chairman, GM-HRD of the bank, Chairman of the school..................................and see the results.


This BM shall be at your doors unannounced to beg apology................................however record (audio/Visual) and keep witness.............................and insist and persist to ask for written apology.


Don't spare such banks , bankers!!!!!!!!!!!!!!!!


Recently BM of Bank of Maharashtra was rude with our united community member and we had escalated the matter properly....................This BM and his officer paid all expenses incurred by the complainant, begged apology in writing and mentioned 'I BEG APOLOGY FOR.....................FROM..........' and pledged that they shall never be rude again........................the management has indicated that they shall suffer penal action now even if complainant writes....................grievance redressed............

Sir,

This amounts to forced secretarial assistance from parents.
Many schools mention such condition in prospectus/advt.

We took such matter with some schools and upon persuasion the school management agreed to open fee counters in school (full time/all days) and started accepting cheques too.


We have taken up the matter with all banks in our locality and have ensured that all banks, bankers shall behave properly and no untoward incidence of misbehavior is tolerated.


We have been firm to the extent that the residents shall lock the bank if banks staff do not treat customers with respect...........................and same bank shall not be let do business in the area............................the business shall be shifted and adamant banker's circle head can come to close the bank instead of opening the bank.

The police personnel that visit the banks have also been educated by the police officials and sense has prevailed.


RBI is found to be soft towards banks, bankers.

The fact of the matter is that the parents do not stand is the same footing as the management of the schools. In the prevailing social milieu, managements can impose any condition on the parents because of the over-concern for the wards.

Hence RBI should certainly take note of the matter and formulate appropriate norms.

Being an end user you can be treated as a consumer however you can very well bring the indifferent attitude of the bank staff to the higher officials, if they donot respond properly, you may escalate the issue to the Banking Ombudsman too for necessary relief and then look for the option to approach consumer forum.

What is your real problem?
There is no established banker-customer relationship between your daughter and the Bank though she remits the fees in the Bank in the account of her school. Come with real problem, I will suggest remedy if possible.
