Discharge is velid in summry trial?

Dear all sir'
(1) In case of summary trial offences whether police has to file charge sheet? if in the investigation they got evidence that accused is innocent? if yes then...
(2) whether discharge application is valid in summary trials? under which saction?

Although it is an academic query, yet to clarify the doubt of author the police may not lodge FIR and dispose of the complaint. Once FIR is lodged police has to investigate and file final report to the court, which may discharge the accused, if the situation warranted so, otherwise, it shall proceed.
