Marriage cancellation

Dear Experts,
I am father of bride.My daughter was engaged with groom one month back in presence of all our relatives.It was done with interest of bride,groon and our both families.I spent two lacks for engagement party and given 2 lacks to groom's family for marriage expenses with my interet as per marriage discussions in presence of relatives.
But now i have dropped the marriage before one week of marriage due to some of my own family issues.
I said the same to groom's family.They are very upset as they already informed and distributed wedding cards to all their relatives.
Now i want to ask them to return my engagement expenses,engagement ring and two lacks money.If they will refuse the same, can i file any case against them for my money?Pl suggest.

Yes, you can file civil suit to get back the money and other items.
However since you have cancelled the marriage, the groom-party is within its rights to deduct such sum as they think incur towards marriage expenses and as damages.

Discuss the matter with the family and elders of groom, settle the matter amicably with intervention of relatives and Panchayat, if required. Accept the amount of cash, cloths and jewellary gifted, but not for party expenses.
If the groom-party is adamant,issue legal notice and file suit for recovery.

1) groom side must also have incurred expenses for wedding . they would be justified in claiming costs incurred by them for marriage expenses . they were willing to go ahead with marriage . you cancelled the marriage . why should they pay for expenses incurred by you for engagement ceremony ?

2) however the Rs 2 lakhs cash which you gave the groom you can ask them to refund after reasonable deductions . similarly engagement ring should be returned by groom along with all other gifts given by you .

3)case may take some years to be disposed of . you will need to prove that you paid rs 2 lakhs for marriage expenses to groom and that expensive gifts were given by you

1. The quantum is most likely to be equalled as the court is likely to adjust the money the groom's side incurs in marriage preparation.
2. The groom side can also file suit for damages as you cancels the marriage resulting in loss of social repute for them.
3. Yes proofs are required.

better contact a local lawyer . where is question of dowry harassment ? you broke the engagement and now you want to sue groom for dowry harassment

Both the parties will have to prove their version after pleadings are complete, then only it can be decided by the Court with the help of Counsels of both sides, how much is to be deducted out of how much (as proved by the contesting parties).

I strongly support the view of Mr.Shroff. You have cancelled the marriage proposal after engagement and would like make police complaint on dowry harassment grounds? This is the blatant misuse of legal process and you will pay for it. Only amicable settlement is suggested from my side.

I agree with views of Mr. Shroff and Mr. Jagga Rao. Being at the wrong end, u should not think of comp[lining against the parents of the Bridegroom. Try to get as much back as possible from the Grooms family by negotiation.

experts have opined and advised more than you expected from them, hence it is you t decide further course of action, i.e., whether to follow it up through legal process or otherwise through intervention by sources known to both the sides.

given facts do not indicate why marriage was cancelled.

If it was your own family issues as you are saying, due to which you cancelled marriage. It is hard to believe as to what family issue could crop up which lead to cancellation (not postponment) of marriage.

You have not indicated any wrong conduct of groom's side BUT in the eye of society you have indirectly painted them as dowry seekers.

cancellation of marriage in less than one week is stigmatic for grooms family if the refusal is from bride side. They will be running around in entire circle to plead that they are not dowry seekers and few of them nay believe them.


In such case you should be sued for defamation.
