Police is going against hc order

(Querist) 16 April 2014 This query is : Resolved
Dear Sir, My Landlady has disconnected my electricity supply in my shop, thus I went to High Court and on his descison Executive
Engineer has passed his order and directed JE for connection.
But after knowing this the landlady has Informed the Police and Police has came and restricted electrification. Now suggest me what to do? As I am suffering from heavy loss due to no Power.
Regards
Rajesh Pandey
Lucknow

Dr J C Vashista (Expert) 17 April 2014
1. Ask landlady to restore electricity connection (in writing) within 2-3 days, if landlady do not get it yourself.
2. Inform the police to restrain interference (in writing) as there is specific direction from HC, provide a copy of order.
3. On her resistance, file petition for Contempt of Court
Sudhir Kumar, Advocate Online (Expert) 17 April 2014
agreed with Dr Vashista. No other way.

In such like cases sometimes HC insists compliance by closing hours. High court also has powers to keep presence of landlady and SHO in court till order is complied.

Advocate. Arunagiri (Expert) 17 April 2014
I agree with the suggestions of Mr.Sudhir Kumar and Mr.Vashista.
Devajyoti Barman (Expert) 17 April 2014
Yes, since the order of HC is resisted you can now file contempt proceeding in the high court.
Now it will be promptly complied with.

Law of Contempt is an English Law. In a contempt case prima-facie the applicant has to prove (a)that the order of the High Court is within the knowledge of the alleged comtemnor and (b) that the contemnor knows English and can understand the meaning of the order. In a contempt petition the role of the applicant is merely an informer and the parties are The Court and the Contemnor.
Rajendra K Goyal (Expert) 17 April 2014
Contempt should be filed. Agree with the experts.

Have you or the Executive Engineer provided a copy of the HC Order to the police?
RAJESH KUMAR PANDEY (Querist) 17 April 2014
Sir, I have provided, now he is agreed that I can go for electrification but when I told SDO regarding this he is saying me to provide Police protaction to his lineman than only he will doen electrification. Now what to do as I am highly frustrated
Guest (Expert) 17 April 2014
The SDO himself can write to the police to provide police protection. What is the hitch for him when Executive Engineer has passed his order and directed JE for restoration of connection?
malipeddi jaggarao (Expert) 17 April 2014
I go with the advice of Dr.Vashista. Follow the guidance given by Expert Mr.Roy.
T. Kalaiselvan, Advocate (Expert) 17 April 2014
Yes the SDO himself can seek police protection for the men working under him and also can file a complaint against the person who is interrupting a government servant from performing his duty. The high court order will be more than enough for the SDO to initiate appropriate action in this regard.
Devajyoti Barman (Expert) 17 April 2014
If you file contempt proceeding all your hassles will be taken care of by the court.
