1- should i file counter on the same date which is given to attend
or

2- will i get time to file counter at next hearing.

If you wish you would be given a chance. Else you can file on the same day.
Rajendra K Goyal (Expert) 15 October 2013
Well advised by the experts, nothing more to add.
Sarvesh Kumar Sharma Advocate (Expert) 15 October 2013
In my view choose 2nd option.
Dr J C Vashista (Expert) 16 October 2013
I agree with Sh. R K Nandaji. File at least 3 days before next date of hearing with an advance copy to opposite party (revisionist) so that the counter affidavit can be taken on record.
prabhakar singh (Expert) 16 October 2013
1)you can do so if you want so,then revisionist would seek time for filling rejoinder.

2)You can seek time to file counter affidavit if for some reasonable difficulty
you could not get it prepared for filing on date.
