Does police have choice

(Querist) 29 January 2012 This query is : Resolved 
police came to native house to enquire about dowry incident happened on marriage date, statement where taken from my relative,
(they are not accused under 498a and they dont live with us). However when chargesheet is filed, their is no mention of them or our neighbour whose statement police took.

Does police have choice about selecting witeness, isnt it their duty to bring all fact to court.

They are police people, they cannot be believed. They can do so.

The p[olice may not ilcude those perosns as witnesses whose evidence may dilute the charge. It is for the accused to call him as witness let him come and say that his statemetn was recorded by police.

some time the police officials record the evidence in case when the complaint is sent under 202 Cr. p.c. and you can examine your neighbours in your defense evidence for the recording of the evidence and others.

Police should produce before the court, all the materials collected during their investigation. They should not suppress any thing. If they suppress that is a offense.

if cops have not relied upon staements of your neighbour /relative you can produce them as your witness to disprove the case .
they can mention the fact that their statement was recorded by police and in the staement thay have categorically mentioned the true facts of the case .

Police was legally obliged to do so but as they were managed for charge sheet hence they did so .

Police has to establish the FIR and has to collect the evidence in and around supporting the allegations of FIR hence practically it is done by police as has been done in the present case.

After submission of charge sheet the investigation is presumed to have been completed.
Now unless the court directs to make further investigation the Police is not supposed to make any investoigation nor visit the locale for questioning them.

Duty of police to produce all recorded evidence in the court.if you want to record some witnesses, produce affidavit in court for send to i.o.
