If the landlord accepts rent from you then by default the tenancy would be created afresh. No need for execution of tenancy agreement.

You should sent the rent amount either by way of money order or cheque which shall be a proof of your deposit of rent. You can demand receipt of past rent by issuing a notice to the landlord..

The legal heirs of the original tenant can remain as tenants for atleast five years after the death of original tenant but the tenancy should be renewed on the name of one of the legal heirs within that period. If the landlord is attempting to evict you other than by due process of law, you may obtain an injunction against him but create records of the payment of monthly rentals without any default.

On death of a tenant, tenancy devolves on heirs subject to law laid down in state rent control Acts regulating urban areas.
As tenant it is your duty to have proofs that you pay rent,so receipt is a must. You shou;d either send it by money order service of post office or should deposit cash in bank account of the land lord or on refusal you can seek it to deposit in court.
