Gifted propety

Sir

My father gifted self acquired property to my mother. my father died recently can my mother sell property to third party with out signature of son.

or my mother can gifted property to his son

On death of father,the property devolve on legal heirs and subject to this right any transaction to be effected

It is a Gifted property of your Father to your mother and Presently she is the Absolute Owner of it and she has got all the Rights to decide about her self Owned Property and Others have No Rights to interfere Legally.

If the gift is by registered gift deed and gift duly accepted by donee then the gift is complete.

It confers title/ownership immediately.

The lady being title holder/owner can dispose her estate/property without anyone's consent.

Being absolute owner of the "gifted" property she may/can/legally competent to dispose it off to any one and at any time (even during life time of donor/husband).

She is owner of property after death of father.

Your mother can sell / gift / mortgage / bequeath a will for her property.

Your mother can gift the property to her son(s) daughter(s) or anyone/third party.


If you are the only son and your mother wants to gift to you, then there is NO issue in it.

With due respect I slightly differ with the expert opinion and legal perception of Mr. Rajendra K Goyal qua ownership and transfer of title of the gifted property, wherein, the donee becomes absolute owner/titleholder from the moment when s/he accepts the donation/gift.

It do not have any concern with and/or wait for the life/death of donor.

Being absolute owner of the gifted property, your mother has full right to dispose that of in any manner she likes.

my father gifted property to my mother 7 years back. now my father expired.
shall my mother can sale to third party /gifted again to grand children or to sons.

the property during his life time with out considering other members objections.
