Validity of 3/4 dp act

(Querist) 31 October 2014 This query is : Resolved
SIR , MY QUARRY IS THAT IF A LADY WIFE FILE DOWRY CASE AGAINST HUSBAND AND HIS FAMILY AND THE CASE IS REGISTERED U/S 498A,406,3/4 DP ACT. AND LATER AFTER THE INVESTIGATION INVESTIGATING OFFICER FILE THE CHARGE SHEET UNDER SECTION 498A,3/4 DP ACT. IF IO REDUCE THE SECTION 406 THEN MY QUARRY IS THAT, THAT WHAT IS THE VALIDITY OF 3/4 DP ACT. AS 3/4 DP ACT IS THE SECTION 3 AND 4 OF DP ACT AND ACCORDING TO THAT IT IS THE PUNISHMENT FOR TAKING DOWRY. ONCE IO OMITTED THE 406 THEN HOW THE 3/4 DP ACT VALID IN CHARGE SHEET.

if THE SAME THING HAPPENED TO ME THEN CAN I WRITE TO SSP OF THE CONCERN POLICE STATION TO TAKE THE CONGNIGENCE AGAINST MY WIFE AND IN-LAWS UNDER SECTION 3 OF DP ACT AS THEY HAVE ACCEPTED THAT THEY HAVE GIVEN THE DOWRY. THOUGH I GOT MARRIED AT GURUDWARA IN SIMPLE MANNER WITHOUT ANY DEMAND AND DOWRY, BUT FALSLY BLAMED.

Offence under DP Act and 406 IPC is of different nature though the same deal with streedhan.
Once section may apply even in absence of another.

Section 3 and 4 of DP act are the convenient twin provision of section 498a being misused by supporters of gender biased law including police. You should thank the police for omitting section 406 of IPC considering it to be a false claim else you may have prepare additionally for returning the jewels and other properties belonging to her though you may not possess them physically or might have been taken away by her while she left your house during dispute.
