Consumer forum query

I had ordered a package of bedsheets from an e-commerce site. I ordered it in June and after receiving, I gifted it in marriage. Today I got to know that it is substandard. When I complained this with the website,they acknowledged and said it is their fault but denied to replace or refund. In their website it is mentioned that they would acknowledge the query in 7 days.But it is more than 4 months now. Can I go to consumer forum and would they listen my request

Yes,You can approach Consumer Forum for your grievances and forum will decide the dispute on merits.your case covers under the sec 2[f] of the Act.

(f) “defect” means any fault, imperfection or shortcoming in the quality, quantity, potency, purity or standard which is required to be maintained by or under any law for the time being in force or 2[under any contract, express or] implied, or as is claimed by the trader in any manner whatsoever in relation to any goods;

it is a fit case for consumer forum but be sure about its jurisdictional clause as many such web portal limit jurisdictional clause to a particular place mainly to the place of their head office only.

1. They have acknowledged the receipt of your complaint but not their fault,

2. Make sure you have all evidence of their deficiency in service and unfair business practice,

3. Also make sure that the website has an office at the place where stay so that you can file your complaint before your District Consumer Dispute redressal Forum,

4. The cost of the goods purchased may not be financially worth taking such action unless it is on moral ground.

As advised, you may approach a local consumer forum with your grievances and bring this sub-standard e-commerce to light so that others will wake up and become aware of consumer awareness.

If you face problemin getting the matter heard in the the jurisdictional Consumer Redressal Forum because of situs of the Supplier( e-coomerce web portal), you can lodge a complaint with the local court having jurisdiction over Cyber crimes in your district stating deliberate deceit of customers.

But since you do not have the address of the vendor you may not be able to complain to the consumer forum.
