Facts Of The Case

  • The petitioner was spotted speaking with a boy, Aalim, in December 2019, which was seen by her mother, and as a result, she was beaten and confined, prohibiting her from speaking to anyone.
  • Because of family pressure, she was forced to leave her parental home on November 23, 2020, at about 8 p.m.
  • She later called her friend Aalim and requested him to rescue her or else she would have committed suicide.
  • The petitioner has been sheltered by a friend, but her family members have been threatening his father and family members.
  • The petitioner's uncle had been calling Aalim's father on a regular basis and presented himself as Ram Kumar, a police officer at PS Narela.
  • The petitioner's counsel stated that the petitioner's family had arranged for her marriage to take place on December 16, 2020, against her desires.
  • The petitioner has said firmly that she does not want to return to her family, that she has been abused and that she expects more beatings, and that she is currently not prepared to return to her family home."
  • Justice Malhotra noted that, according to the petitioner's father and uncle, she is a minor, and that a false Aadhar Card has been presented on his behalf in collaboration with Aalim.

Courts Order

  • Regarding the subject and the facts in dispute, Court ordered that the name of the petitioner be masked in the entire record and not disclosed in any report or copies of proceedings or any form of communication by any person other than the authorities dealing with the relevant inquiry, investigation, and judicial procedure. Wherever necessary, she will be referred to as Ms.X.
  • The High Court took noted all the background facts and opposing arguments and, at the time, deemed it appropriate that the petitioner be lodged at Kasturba Gandhi National Memorial Trust, Bhaktawapur, and directed that the Chairperson CWC-10 Alipur ensure the petitioner's adequate safety, protection, and education.
