SUMMARY

  • In the present case, the complaint had been initially made because the accused had refused to marry the complainant. He stated that since the girl belonged to the Scheduled Caste community, his father did not consent to the marriage.
  • The accused had initially assured the complainant that caste considerations would not bar him from marrying her and had established physical relations with her.
  • The accused was alleged of having intoxicated her, violated her and also took her photographs without her permission, according to the initial complaint. He was accused of rape.
  • However, later on both of them entered into a compromise to marriage.

BENCH’S POINT OF VIEW

  • The Bench comprising of Chief Justice S.A. Bobde, Justice A.S. Bopanna and V Subramanian stayed the arrest of the accused.
  • However, they warned the accused of any mischief.
  • 'Remember, we will send you to jail if we find that your proposal to marry her is just a ploy to get rid of the criminal case against you', said the Bench.
