Working hours for it company in goa

Hello All,

We are working in a startup in Goa, which has arrived here from pune.
The work schedule is made of 10 hrs a day, and 5 days a week.
I wanted confirmation about legal terms for a company having 5 work days in a week , and what are the number of hours which should be considered per day as a work day.

The company should be covered by The Goa, Daman and Diu Shops and Establishments Act, 1973

Sec:2(4,7,8,24…),3,10,11,13

Work hours:8/day,48/week…………………………..above it OT shall be applicable.

OT allowed is: 6/week……………

You are entitled for OT.

Obtain daily work hours in writing and claim OT that should be paid along with monthly wages on usual pay day……..

Authority that can be approached is :

Inspector under The Goa, Daman and Diu Shops and Establishments Act, 1973

 

Inspector under Payment of Wages Act………….

O/o Labor Commissioner

The IT/ITeS employees have formed unions and trade unions are willing to embrace them.

Employee’s can form Works Committees and Works Committee is an authority under ID Act…………..and united employees can negotiate service conditions.

Are you aware that  ‘‘Work’s Committee’ is an authority under ID Act and employee’s can negotiate service conditions with employers……………………………..and that Chairman/President is from Employee’s side and the committee has equal number of employee’s as members?????

Encourage the fellow employees to unite and consult in time.

Should this Work hours include Break / Rest Period ? as in 8 = ( 7 hours working and 1 hr Break )
What about the case of a 5 Day week and 9hrs a day shift ? Should it be ( 8 Hours work and 1 hr break ) ?

Go thru: Sec12: Interval for rest.

 

Spend some time in going thru the Act carefully.

It is easy to understand.
