What happen to the roof right?

We have been owner to a housing plot in Delhi, with a family house constructed. It has three owners A, B, C of which two (B, C) live in here.

Now we are getting the house reconstructed through builder. Accordingly he has promised to provide two floors to us. According to his deed he says we will bear ownership of 25% + 25% = 50% of plot and also he would pay of third partner’s share.

B & C are taking upper ground (above parking) and top floor.

Now as the floors are built, what will happen to the roof right?

  1. Does roof is divided amongst all new owner in equal parts.
  2. Or roof belong to the existing two owners (B, C) even after reconstruction.
  3. Or owner of top floor hold right to roof.

Also, in-case of top floor being the owner of roof, thus he also has the right to construct the fifth floor, if allowed by respective Municipal Corporation, in future.

HOW CAN I PROTECT MY ROOF RIGHT, PLEASE RESPOND AT EARLIEST (within 24 Hrs.)

Other than this, what happen to right of roof among two existing owner incase, builder is ready to provide NOC (share remaining as 25% as specified in deed) for the two floor he is taking possesion of.
