Vat / st on resale unregistered flat

Dear Sir / Madam,

 

I intend to purchase a resale flat in Mumbai. The flat is not registered by the seller (he has an allocation letter for the flat) and I believe that the project has received OC. Please advise in this case who will pay the VAT and Service Tax.
