Validity of a document issued under unenforced law.

In Arunachal Pradesh THE INDIAN SUCCESSION ACT 1925 has not been enforced till date yet the local courts issue succession certificate under the authority of the Act. Are they legally valid?

dear querist,

the succesion certificate issued by the local courts are legally valid but local laws /customs will over come such certificates as customs are always treated as supreme over any law.

The question is how a document issued under unenforced law can bwe valid.  in matters of state list ,the law is effective in a state only when the atate legislative assembly adopts it. In the present context, the Indian succession Act has been specifically notified by the State Govt. that it shall not be applicable in its territory.
