Un divided share of land

Dear All the members

I am income tax consultant, one of my client posed a question to me i.e.,

He developed a site  in Hyderabad and constructs 8 flats, the area of the land is 300 square yards. Each flat is 1000 square feet. each flat has to receive undivided land of 37.50 square yards, is it legal if he registers undivided land of 35 Square yards to 7 people and the balance to the other flat? Is there any law that undivided land should be pro-rata on the flat area?

The owner of the basement too is entitled for an undivided share and he must claim it.

Otherwise, when the building is developed or sold, the owner of the basement cannot claim any right over the property.
