Transfer of property

Dear Sirs,

I need to know whether I can transfer / gift a property in my name to my relative when I have a divorce case filed against me? What are the legal provisions for the same? Secondly we have not even filed the vakalatnama ( I shall be filing the same on 8th). Can I transfer/ sell/ gift this property after filing the vakaltanama or before the same? Is there any provision under the law where-in I can make the papers in the next two days and register it next week. Kindly guide

Yes, you can transfer your property while the divorce case is pending against you.

It is better to transfer the property before appearing in the case.

Pendency of a divorce case is no bar to transferring the property which is in your name. Transfer it through a registered gift deed.
