Transfer of chs flat to wife after husband's death

My father expired in July 2016. He owns a flat in Kamothe, Navi Mumbai in a cooperative housing society. He had not done any nomination for the flat, We want to get the flat transferred to my mother's name and also mutated in her name. Our Family is mother , daughter and me What is the procedure for the transfer? What documents are required and how long would it usually take? Who can I approach for getting all this done? Please help.

First: The Secretary of Society.

The society may agree on the basis of NOC by all legal heirs in favor of Mother and/or registered relinquishment deed, indemnity from all, affidavits, death certificate, legal hier affidavt/certificate etc..........  

 

Submit under proepr acknowledgment.

SIMPLE OPTION:

1.  Execute a "Family Settlement Deed" with all the participating Class-I Legal Heirs of the deceased and record therein that the Deceased's property is unconditionally relinquished in favor of Mother.


2.  The above will subsequently legally enable the Mother, to Sell /Gift /Will /Transfer the property in future.

Registered Family Agreement is certainly best option.
