Transfer fee

Dear Sir, My name is Milan M. Gandhi staying Mumbai area Ghatkopar-East. My query is we have received Gift Deed wherein Father is gifting a flat to her daughter who is married. As per one member the flat owner is liable to pay transfer fee of Rs. 25000 to society since daughter is married and her family name is changed since she is married. Kindly confirm if society can take Rs. 25000 as transfer in any form. Thanks and Best Regards, Milan M. Gandhi

Refer to society bye laws framed in accordance with Model Bye Laws.

Then relate with Model Bye Laws.

No. Transfer fee  is not that much. You can refer the following case.

the authorities have tried to emphasize that Transfer Charges should be capped under 10000/- only. In 2014, the Punjab and Haryana High Court passed a judgment based on the Delhi High Court’s 2009 order to stop this practice immediately and all the Cooperative house building, group housing and maintenance societies etc. shall not charge more than 10000/- as the transfer fee.
