Token amount recovery

Hello Sir,

I purchased a property and gave the seller 8lacs as token amount against the property as per MOU signed by buyer and seller both. As per the clause of MOU if I want to cancel the Deal than the seller will pay me the Token amount after deducting all taxes and expenses incured by him and when the deal of the property will be held with another buyer only and I signed the MOU by oversight of this clause which was my mistake.
Now when we asked him to show the Orignal Documents of the said property he refused to show the same and told us that he will show the documents in Bank only and when we will pay him total property amount. But our Bank told that first they want to see the Original documents to issue the loan but he is not agree to give us paper in front of bank. So we came under doubt and we investigate his ownership and documentation, we came to know that the document chain was not proper so we decided to cancel the deal but now he is refusing to pay back the token amount
