Hi,
If my wife is more educated than me and eaning 35% of my salary then, May I need to give her maintance. My parents are also leaving with me. She left me around 2 years back after three months of our marriage and now saying I am ready to come to stay with you. But we are no trust on she and her family aiso. She filled counter claim for intrim maintance.

The liability to pay maintenance to the wife can be avoided in the following circumstances, namely.
1. If the wife deserted the husband without any sufficient cause.
2. If the wife is earning an amount which is sufficient for her to maintain herself on her own.
If you succeed in proving the above two, you may escape the liability to maintain her. Interim maintenance would have to be paid though.

rather than showing that she is earning 35%, show that her income is sufficient to maintain herself.
