time frame to appeal in SC

I have been told that after the High court judgement  there is a 90 days period where one can appeal in supremecourt ,

now i am being told that 90 days time frame to appeal in supreme court is after the high court judegment  is processed .

what does Processed means ?

if the judgement was given on oct 09  does it mean by dec 09 i can appeal in SC

or the judgement from high court has to go to lower court , after that i have 90 days ?if so normaly how long does it take for the judgement to go to lower court ?

my lawyer got the certified copy of the judgement on  the next day of the judgement .

what is the correct time frame i have to appeal in SC

ninty days means from the date of the judgment in High Court.  Only the period that has been taken in preparation of certified copy of the judgement will be excluded and in your case that is only a day. For example the date of judgment is 3.10.2009.  In october 29 days, in november 30 days and in december 31 days.  On 1.1.2010 you have to file SLP in Supreme Court.  As 1st Jan. being holiday, on the next working day you can file it.  If any delay is caused in fling SLP, you are not helpless.  You can move application for condonation of delay and it may be allowed if you show sufficient reason for delay.
