Hi one of my friend is terminated from job in kickdown without giving any salary and reason.
We has working from last 3 yrs as PGT have appointment letter and salary slips.
We was on board duty for copy correction from 16 March 2020 and on 20 March lockdown imposed. Copy correction was incomplete, and he corrected remaining copies in May 2020 as per HE request and CBSE instructions.
In June he was terminated without any salary for April and May, without giving him any reason.
In case your friend was a Central Government Employee, he/she can approach the CAT for his/her illegal termination and reinstatement. It will be better if all the documents are tallied for this case before filing any case!!
1. Teacher may raise the dispute in writing to withdraw the letter of termination as well as asking for the money. Assuming that no communication has already been made by the teacher, it is already late as six months have passed from the date of termination. So without further delay, letter needs to be sent immidiately.
2. If option 1 does not work, legal notice may be followed.
3. Teachers do not fall under the Industrial Disputes Act. Hence, remedy is not very easy. So one may consult a lawyer dealing with service matters with all documents/ papers.
