Tenant brother lives in property

the said younger brother cannot be claimed as tenant as there is no privity of contract between you and him. Thus, he has no right of tenancy. you may ask the tenant to vacate the premises as someone else is residing instead of him.

Else, you may terminate the old tenancy agreement and execute a fresh one with the younger brother.
