Tamil Nadu new tenancy act Sec 23

Dear experts,
I own a shopping complex and let out to interior decoration namely Mr. X. tenant for a decade.
1. Mr. X and me never under went a lease deed between us.
2. Issued a legal notice by me to evacuate the premises and pay of the rent arrears after deduction advance amount.
3. Mr. X claims, he paid advance rs 10.00 lakh and no arrears of rent till 31.01.2020.
4. Planed to file a RLTOP by me.
5. Agreed ( verbal ) rent as per me rs 5000 per month. Agreed ( verbal ) rent as per Mr. X is Rs 2,000.
6. After 31.01.2020 he never paid a single penny.
My query :
a. when RLTOP is filed and requested for IA u/s 23 to pay rent in court. i) Rent controller wheather claims the rental amount of land lord or Mr. X.
ii) Rent controller orders to pay compensation of double the monthly rent.

depends upon the merits of each case and circumstances .

Just file for eviction . Never accept any oral agreement. Get the lease agrement done afresh if he comes to terms and make that conditional.
