suit for Execution or writ petition

Despite several petitions and Court specific orders to remove the constructions made without set backs. The MCH has not taken action. Can I file a suit for Execution or file a writ petition, which one is beneficial for me.

If there is Judicial order then u have to file a contempt petition of the said order vide which the court has directed to remove the same. fiing suit or the writ petition for the execution of the orer is abuse of the process.
