Sufficient cause for tenant eviction

we had a tenant for 2 yrs, who had not been timely ( unpredictable ) paying rent and when I asked him to leave , he refuses to vacate saying that he is going to be transfered in next 3 months.He refuses to sign a new lease agrement saying that he will be transferred but he did not get transferred for last 6 month. delays the rent for some time 15 some time 25 days  from due date which is 7th of every month. We have take this house on emi, and after suffering at the hands of tenant want to sell the flat , to make pre-payment of the flat in which I am staying ( both flat on emi) .Now he is saying that we can go to court. Is my selling of flat to reduce my emi burden be a sufficient cause to evict the tenant.

you first legal notice and file either rent dues case or eviction case against tenant.
