Succession certificate

Dear Lawyers Club Friends

Is it necessary to have sucession certificate, if a person (who died) has made unregistered will and no one has dispute on the property?

Thanks & Regards

Dear Vinod ,

since it is an unregistered will, you will have to probate the same document before a competent court to bring the document into force. This procedure largely saves any legal hassles from the legal heirs in future and will help in smooth mutation of the property
