About Stilt Parking :
On your site, there is a question about the ‘Stilt Parking ownership in Co-operative society’. The brief descriptttion of the question is : A builder sold the stilt parking to a flat buyer but society did not accept the allotment done by the builder. And all the lawyers rightly advocated the stand of the society.
Here, what has happened,….... the society has protected the rights of the other members.
Now, I am going to tell you my case where the society ( rather the managing committee ) is ignoring the rights of the other members, and is supporting to the non-members.
On the contrary making huge loss in crores to the society.
Near about year - 2000, while developing the 2 old buildings, in the agreement made between the society and the builder, the builder kept all the ( selling ) rights of parking with him only.
Further, the clause was also made to make the purchaser of the stilt parking, to be made member of the society.
And according to the agreement, the builder sold the 2 stilt parking to the non-members ( non flat owners ) of the society at the price of Rs.75,000- .
And so society made the non-members ( non flat owners ), the members of the society by offering them shares of the society.
One more stilt parking was sold to the regular member but he was also given shares for that stilt parking space.
The builder also made the sell deed with the purchasers.
The purchasers also paid stamp duty on that sell deed.
The price of the 300 sq. ft. flat, at that time was 10 to 12 Lacks.
There is clear mention of 3 stilt parking ( not garage ) in the building map.
Now, after 16- 17 years, while I was fighting for the other issues, I came to know about this facts.
So, I complained to the Deputy Registrar, 30th April 2016 and pursuing the matter.
My question are :
1. Is there any remedy to stop this illegal practice, without going to the court ?
2. Is this the practice of the Rich people and the Government Servants to do the illegal things and ask the common people to go to the court , ( which they can not do ) and thus take the advantage, benefits and awards ?
