Sra - listed in annexure-2 as not qualified

Hi,

I am a resident of Ramabai Colony Ghatkopar (East), Mumbai 400075.  Our area is under SRA & being undertaken by Pentagon Builder for Re-development.

I had bought my room in 2002 and after the District Collector Survey, in Annexure - II my name is tagged as 'Not Qualified' (Aapattra in Marathi).  On the suggestion from the Society and Builder I have submitted an appeal to SRA (through Society) thrice with the documentary evidence prior to 1995 (like light-bill, BMC SC receipts) of the previous tenant (who had the allotment paper of 1966 in his name, handed-over to me) stating to make me qualified.

Builder and Society are now compelling me to vacate my room before I am tagged as qualified, based on their assurance on Society letter head that they will be paying necessary transfer fees on our behalf based on the GR published by Maharashtra Govt on 2nd January 2012 to provide conditional qualification till the SRA investigation is done.

My questions are as below, as I have bought my room in 2002:

  • Would I be eligible to be qualified based on the documents of previous tenant (as detailed above)?
  • Should I handover my room to Builder based on the assurance by the Society & Builder on Society letter head?
  • What is conditional qualification?  Does this mean that if under SRA investigation if I am not tagged as Qualified I will not be allotted my unit in the Rehab building?

Hoping that I will get a clean advice that will help me to take proper decision.
