Shope possession

Dear Sir / Madam,

Am a resident of Goa and I have purchased 2 Shops in a Commercial and Residential Building project, I have paid almost 90% (Approx. Rs. 20 lacks) of the shop value based on the agreement and suppose to give me the possession by September 2012 as per the agreement. When I enquired with the Builder regarding the possession he just said that it will take another 3-6 months.

But by the time I came to know that there is a legal case filled by someone against the Builder for doing additional one floor illegal that is why it’s not possible (not in the approved building plan). Till date, am following with the Builder as when he is going to finalize and give me the possession, he only says the file is being moved from this department to that department and its taking time.

I have also requested him to give my money back as all these years I waited by thinking it will finish but the years are just passing by and nothing has happened.

So, please let me know what is to be done and whether I have to take a legal action against the builder or to file a case in the Consumer Dispute Court.

I will appreciate your early reply.

you can file a case in the district consumer forum against the builder for deficiency in services
