Shifting of booking to other builder property

I hv booked an under construction flat about 1.5 yrs back. One promoter cum broker was also involved in the deal. Till date the construction has not started . Now the broker is advising us to shift the booking to other property of different builder. Broker is telling that my down payment will be shifted to new property through an MOU and my earlier booking will be removed from my PAN and other tax records. Is this a legal way or the broker is trying to fool me once again? I need expert legal advice on this issue .
