Share in inherited

Sir,

My grandfather had some agriculture residential property, some of which he purchased and some was allotted after 1947 partition, now my father and two uncles (i.e. Tau ji & Chacha ji) had divided in equal share with mutual consent and same was entered into revenue record.

My father has five children (one my self & four sisters). Total Value of the property which was inherited by father is around 1.50 Crore (excluding a residential property he purchased on my mother's name).

Now few months back  i had lost Rs. 25 Lacs in my business, and i  became penniless, i have to repay the amount in the market. i asked my father to help me by mean of giving me share in the property from my grandfather or cash equivalent to that share. but my father refused to give me the amount or the share.

my query is that can i entitled to claim the share in my father's inherited property or not. if yes, how much time  approximately court of law takes to give me, my share.

your valuable guidance is awaited

thanks

H Singh

The property which a Hindu inherits from his father is his separate proprty which is at par with his self acquired property, capable of being willed and gifted by him. Unless you can prove that the property which came to be inherited by your father is ancestral in nature you have no share in the property .
